Agreement to Terms

By accessing and using Vibe Backup, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this application.

Definitions

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use the Application for your personal or commercial use in accordance with its intended purpose.

• •You may not modify, adapt, or create derivative works based on the Application
• •You may not distribute, sublicense, or transfer the Application to third parties
• •You may not use the Application for any unlawful or prohibited purpose

User Responsibilities

• •You are responsible for maintaining the confidentiality of your account and password
• •You must ensure that your use of the Application complies with all applicable laws
• •You are responsible for the security and backup of your data
• •You must not use the Application to store or transmit malicious code or illegal content
• •You must respect the intellectual property rights of others
• •You must provide accurate information when creating an account or making purchases

Data and Privacy

Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the Application, to understand our practices regarding the collection and use of your information.

• •Your Content is encrypted and stored securely
• •You can delete your Content at any time
• •We do not access your Content unless required for technical support

Payment and Refunds

Vibe Backup is available as a one-time purchase through the Mac App Store or our website. Payment terms are as follows:

• •All payments are processed securely through Apple's App Store or our payment processor
• •Prices are subject to change with notice
• •Refunds are subject to Apple's App Store refund policy or our 30-day money-back guarantee
• •All sales are final after the refund period
• •You are responsible for any applicable taxes

Intellectual Property

The Application and its original content, features, and functionality are owned by Vibe Backup and are protected by international copyright, trademark, and other intellectual property laws.

• •All rights, title, and interest in the Application remain with Vibe Backup
• •The Vibe Backup name and logo are trademarks of Vibe Backup
• •You may not use our trademarks without written permission
• •Any feedback or suggestions you provide may be used by us without compensation

Warranties and Disclaimers

The Application is provided 'as is' and 'as available' without warranties of any kind, either express or implied.

• •We do not warrant that the Application will be uninterrupted or error-free
• •We do not warrant that the Application will meet your specific requirements
• •We do not warrant the accuracy, reliability, or completeness of any information
• •We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose

Limitation of Liability

In no event shall Vibe Backup be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, or use, arising out of or relating to your use of the Application.

• •We are not liable for any data loss or corruption
• •We are not liable for any third-party actions or content
• •We are not liable for any system failures or security breaches

Termination

We may terminate or suspend your access to the Application immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

• •Upon termination, your right to use the Application will cease immediately
• •You may delete the Application from your devices
• •We may delete your account and data after a reasonable period
• •Provisions that by their nature should survive termination shall remain in effect

Updates and Modifications

We reserve the right to modify or discontinue the Application (or any part thereof) temporarily or permanently with or without notice. We also reserve the right to update these Terms at any time.

Governing Law

These Terms shall be interpreted and governed by the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Application shall be resolved in the courts of the United States.
